There will be a Special Municipal Election on November 5 when Liberty voters will be given the opportunity to vote on “short-term lending code and permit fee”. The official ballot language will be as follows:
Shall the City of Liberty adopt a Short-Term Lending Code to include regulations on zoning requirements, population density restrictions, and establishment of a permit fee for all existing and new short-term loan establishment applicants in the amount of $5,000 per year, or $2,500 if less than six (6) months remain in the calendar year on the date a permit is issued?
INSTRUCTIONS TO VOTERS: If you are in favor of the question, place an X in the box opposite Yes. If you are opposed to the question, place an X in the box opposite No. The polling places will open at 6 a.m. and close at 7 p.m. on Nov. 5.
BACKGROUND: This ballot measure came through as a citizen initiative petition received on April 18, 2019 to amend the Liberty City Code pertaining to Payday Loan and Title Loan Businesses in Liberty. The Clay County Board of Election Commissioners verified that the petition contained 1,270 valid signatures (meeting the requirement of 747, per the calculation set out in RSMO 78.200). Upon completion of legal counsel review, the Deputy City Clerk verified that this is a valid petition on July 12, 2019 and brought it forward for consideration by the Liberty City Council. The City Council voted to bring both the proposed ordinance and the new fee as a ballot question before the voters.
