CITY COUNCIL MEETING
MINUTES
MONDAY, JANUARY 25, 2010
I. CALL TO ORDER
A regular meeting of the City Council of the City of Liberty, Missouri was held in the Council Chambers at City Hall on January 25, 2010 with Mayor Greg Canuteson presiding. Mayor Canuteson called the meeting to order at 7:00 p.m.
II. INVOCATION AND PLEDGE OF ALLEGIANCE
The invocation was given by Tyler Tankersley, Second Baptist Church Student Pastor. Council Member Jenness then led the pledge of allegiance.
III. ROLL CALL
Roll call was answered by Paul Jenness, Ward I; Greg Duncan, Ward II; Lyndell Brenton and Jeff Watt, Ward III; and Fred Foster and Nick King, Ward IV. Also in attendance were Curt Wenson, City Administrator; Dan Estes, Assistant City Administrator; Steve Hansen, Public Works Director; Steve Anderson, Planning and Development Director; Amy Brusven, Human Resources Director; Tim Moore, Police Lieutenant; Gary Birch, Fire Chief; Dennis Dovel, Parks and Recreation Director; Tony Sage, Information Services Director; Brian Hess, Assistant Public Works Director; Karan Johnson, Economic and Business Development Manager; Anna Slocum, Assistant Parks and Recreation Director; Donna Kay Taylor, Community Center Manager, Charles Anderson, Sr. Recreation Coordinator; Debbie Abernathy, Building Maintenance Technician; Shawnna Funderburk, Assistant to the City Administrator; Janet Pittman, Deputy City Clerk; Angie Borgedalen, Liberty Tribune; and 10 members of the public.

V. CITIZENS' PARTICIPATION
Mayor Canuteson read and presented proclamations of commendation to Donna Kay Taylor, Charles Anderson and Debbie Abernathy for their actions during a recent critical incident at the Liberty Community Center.
Rob Jones, Historic Downtown Liberty, Inc. Board Member announced that Vicki Vance had been selected as the new Executive Director.
Council Member Moore entered the meeting at 7:10 p.m.

A. ACKNOWLEDGEMENT OF VENDOR PAYMENTS FROM DECEMBER 31, 2010 THROUGH JANUARY 15, 2010
1. EXCLUDING KCP&L PAYMENTS - ORDINANCE
Document No. 7118 was read. Council Member King moved to approve the vendor payments. Council Member Watt seconded the motion. Vote on the motion was as follows: Council Member Moore - yes; Council Member Brenton - yes; Council Member Foster - yes; Council Member Jenness - yes; Council Member Duncan - yes; Council Member Watt - yes; Council Member King - yes. The motion carried unanimously; it was approved by the Chair and inscribed in Ordinance No. 9544.
2. KCP&L PAYMENTS - ORDINANCE
Document No. 7119 was read. Council Member King moved to approve the vendor payments. Council Member Jenness seconded the motion. Vote on the motion was as follows: Council Member Moore - yes; Council Member Brenton - abstain; Council Member Foster - yes; Council Member Jenness - yes; Council Member Duncan - yes; Council Member Watt -yes; Council Member King - yes. The motion carried 6-0-1; with Council Member Brenton abstaining, due to a potential conflict of interest. It was approved by the Chair and inscribed in Ordinance No. 9544.
B. RESOLUTION RECOGNIZING CORBIN THEATRE COMPANY AS THE COMMUNITY THEATRE FOR THE CITY OF LIBERTY
Council Member King moved to approve the resolution. Council Member Moore seconded the motion, which carried unanimously and is inscribed in Resolution No. 2450.
C. RESOLUTION APPROVING A TEMPORARY USE PERMIT TO ALLOW THE TEMPORARY SALE OF VALENTINE FLOWERS AND GIFTS BY HOLIDAY EVENTS, FROM FEBRUARY 10 TO FEBRUARY 14, 2010, AT KANSAS STREET AND BLUE JAY DRIVE, LOT B3, SHOPPES AT LIBERTY TRIANGLE, LIBERTY, MISSOURI
Mayor Canuteson stated that the applicant had withdrawn their appeal.
D. AN ORDINANCE AmendING Chapter 25, "streets And Sidewalks" Of The Code Of The City Of Liberty (Excavation In The Right-Of-Way) - (2nd reading)
Council discussed the proposed amendments to Chapter 25.
Council Member Watt moved to amend the original ordinance with the recommended amendments as presented. Council Member Jenness seconded the motion, which carried unanimously.
Council Member Brenton moved to approve the amended ordinance. Council Member King seconded the motion, which carried unanimously. It was approved by the Chair and is inscribed in Ordinance No. 9545.
E. ORDINANCE APPROVING THE SECOND AMENDMENT TO THE TAX INCREMENT FINANCE REDEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY AND ROGERS SPORTING GOODS AND AUTHORIZING THE MAYOR OF THE CITY TO EXECUTE THE SECOND AMENDMENT (2nd reading)
Council discussed the proposed amendments to the Second Amendment.
Council Member Watt moved to include the word 'new' in front of loan, under Item 4, subsection 5). Council Member Jenness seconded the motion, which carried unanimously.
Council Member King moved to amend the proposed Second Amendment with the recommended amendments as presented. Council Member Watt seconded the motion, which carried 6-1-0. Council Member Foster voted in opposition.
Council discussed the proposed ordinance approving the Second Amendment to the Rogers TIF agreement.
Council Member Brenton moved to strike the word 'necessary' from the 8th whereas and insert the word 'special' before 'relocation' and the word 'circumstance' after; and in the 9th whereas to strike the remainder of the sentence after the word 'community'. Council Member Moore seconded the motion, which carried 6-1-0. Council Member Foster voted in opposition.
Council Member King moved to amend the ordinance with the recommended changes. Council Member Watt seconded the motion, which carried 6-1-0. Council Member Foster voted in opposition.
Council Member Jenness moved to approve the amended ordinance. Council Member Brenton seconded the motion, which carried 6-1-0. Council Member Foster voted in opposition. It was approved by the Chair and is inscribed in Ordinance No. 9546.
F. SANITARY SEWER REHABILITATION GRANT PROJECT
1. ORDINANCE AMENDING ORDINANCE NO. 9533 APPROVING A CONTRACT WITH WIEDENMANN & GODFREY CONSTRUCTION, INC. FOR THE SANITARY SEWER REHABILITATION PROJECT - PHASE 1
Document No. 7120 was read. Council Member Jenness moved to waive the rules and consider the ordinance on first reading. Council Member Watt seconded the motion, which carried unanimously.
Council Member King moved to approve the ordinance. Council Member Moore seconded the motion, which carried unanimously. It was approved by the Chair and is inscribed in Ordinance No. 9547.
2. AN ORDINANCE AMENDING ORDINANCE NO. 9534 APPROVING A CONTRACT WITH HAVENS CONSTRUCTION COMPANY, INC. FOR THE SANITARY SEWER REHABILITATION PROJECT - PHASE 2
Document No. 7121 was read. Council Member Jenness moved to waive the rules and consider the ordinance on first reading. Council Member Watt seconded the motion, which carried unanimously.
Council Member Watt moved to approve the ordinance. Council Member Duncan seconded the motion, which carried unanimously. It was approved by the Chair and is inscribed in Ordinance No. 9548.
G. ORDINANCE ESTABLISHING THE SINGLE FAMILY RESIDENTIAL HOMEBUILDING INCENTIVE PROGRAM
Council discussed the proposed incentive program. Randy Waits, partner in the Camelot Commons development, requested that attached single family homes be included in the proposed program.
Document No. 7122 was read. Council Member King moved to waive the rules and consider the ordinance on first reading. Council Member Watt seconded the motion, which carried unanimously.
Council Member Brenton moved to strike Item 4 under Section III from the ordinance. Council Member Moore seconded the motion, which failed to carry by a vote of 3-4-0. Council Members King, Jenness, Foster and Watt voted in opposition.
Council Member King moved to approve the ordinance as presented. Council Member Watt seconded the motion, which carried 6-1-0. Council Member Brenton voted in opposition. It was approved by the Chair and is inscribed in Ordinance No. 9549
